These Terms and Conditions ("Terms") govern your access to and use of the Kids Eat Free Club mobile application, the website at https://kidseatfree.club, and related services (together, the "Service"), operated by Kids Eat Free Club ("we", "us", "our").

Please read these Terms carefully before using the App or the Website.

Our Privacy Policy explains how we collect and use personal information.

1. Acceptance of Terms

By downloading, installing, browsing the Website, creating an account, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

We may update these Terms from time to time. Continued use after an update constitutes acceptance of the revised Terms. Where a change is material, we will take reasonable steps to notify you in the App, on the Website, or by email.

2. Who we are and what we provide

Kids Eat Free Club is a directory and discovery service that helps families find restaurants, cafes, and other venues that advertise free or discounted children's meals, limited promotional offers (including Hot Deals), partner perks, and related family offers.

The Service includes:

  • the Kids Eat Free Club App;
  • the Website at https://kidseatfree.club, including prize-draw information, marketing pages, and any restaurant partner tools hosted there; and
  • emails, notifications, and related communications.

You may browse some Website pages without an account. Features such as saving deals, claiming offers, referrals, and Premium require an App account.

We are a technology platform. We do not own, operate, manage, or control any listed restaurant or venue unless we expressly say otherwise. We are not the merchant of record for meals, bookings, or discounts offered by venues. A listing in the App or on our Website is an advertisement of an offer made by the venue, not a contract between you and us for that meal or discount.

3. Eligibility and your account

You must be at least 18 years old to create an account. You are responsible for the accuracy of the information you provide, for keeping your login details confidential, and for all activity under your account.

You must not share your account, create multiple accounts to circumvent limits, or impersonate another person. We may suspend or close accounts that we reasonably believe are used in breach of these Terms or to abuse deals, referrals, or prize draws.

4. Membership, Premium, and billing

The Service may include a free tier and optional paid membership ("Premium"). Premium pricing, benefits, and billing period are as shown in the App at the time of purchase.

Paid memberships purchased through the Apple App Store or Google Play are billed and managed by Apple or Google under their terms. Cancel or manage those subscriptions in your Apple or Google account settings. Unless required by law (including the Australian Consumer Law), fees are non-refundable and we do not provide partial refunds for unused periods.

We may change Premium benefits or pricing for future periods. Changes will not affect a period you have already paid for, except as required by law.

5. Restaurant deals, accuracy, and no guarantee of a discount

Deal details in the App and on our Website — including days, times, suburbs, distances, cuisine, prices, sweetener text, stock remaining, photos, phone numbers, menus, and conditions — are provided for general information only. Venues set their own offers and may change, limit, suspend, or withdraw them without telling us.

We do not warrant that any listing is accurate, complete, current, or available. We are not liable if:

  • published information is incorrect, out of date, incomplete, or misleading through no fault of yours that we are required by law to remedy;
  • a venue refuses, restricts, or fails to honour a deal or discount listed in the App or on our Website;
  • a deal is sold out, limited to certain days or times, subject to a minimum adult spend, requires children to be present, requires a booking, or is otherwise conditional;
  • you travel to a venue and do not receive the advertised benefit;
  • photos, ratings, busy-ness, or maps do not match what you find in person.

Always confirm the offer, conditions, and availability directly with the venue before you visit or spend money. Showing the App or Website does not create a right to a discount. Hot Deals and other limited offers may run out, and remaining quantities shown in the App may lag behind actual stock.

6. Bookings, claims, and venue visits

Where the App helps you hold a Hot Deal, request a table, or claim a deal, you are still dealing with the venue. We do not guarantee a table, a particular sitting time, or that the venue will accept your party.

You must follow the venue's house rules and any conditions shown for the deal. On-site claims may require you to be at the venue (including location checks or QR scans). Misuse of claims, holds, or QR codes may result in the deal being cancelled and your account being limited.

Any contract for food, beverage, or hospitality is between you and the venue. Complaints about service, food safety, allergies, billing at the venue, or the meal itself should be raised with the venue.

7. Monthly prize draw, referrals, Affiliate & Influencer program, and Mombassador program

From time to time we run a referral promotion and monthly prize draw (for example coffee, meals, or cash prizes) as described in the App and on the Website. Entry requirements, prize details, draw dates, eligibility, and how winners are chosen are published on https://kidseatfree.club. Those Website terms prevail if they differ from in-App promotional copy.

We run two cash-reward referral programs that share the same published payout rates:

Members who join either program on the Website, or who customise their personal share link in the App, enrol in the relevant cash-reward program. Both pay cash rewards for qualified parent referrals, Premium upgrades, restaurant introductions, retention bonuses, and published milestones. Program details, eligibility, payout thresholds, and prohibited conduct are published on those pages. Cash-reward payouts are separate from prize-draw entries. Enrolling opts you out of prize-draw points for that referral activity.

Winners will be notified by email to the address on their Kids Eat Free Club account. We are not responsible if a winner cannot be contacted because their email is incorrect, full, filtered, or unmonitored. Unclaimed prizes may be redrawn or forfeited as set out in the Website terms.

The prize draw is a promotion, not a guarantee that you will win. Referral activity that we reasonably consider to be spam, fake accounts, self-referral, or abuse may be disqualified. Referring friends does not shorten any waitlist; waitlist timing (where used) is determined by us. We may withhold Affiliate, Influencer, or Mombassador payouts for the same reasons. We do not guarantee income from either program.

All payouts in the Mumbassador & Affiliate program are at the sole discretion of Kids Eat Free Club. No arbitration is allowed.

8. Location, maps, and search

If you allow location access, we may use your device location to show nearby deals and distances. If you decline, we use the home area you provided at signup or in Profile. Distances and "near you" results are estimates only.

Map search and suburb autocomplete may use third-party services (including Google). Those providers have their own terms. We are not responsible for geocoding errors, map tiles, or search suggestions.

9. User content and reviews

If you submit reviews, photos, feedback, or other content (in the App or via the Website), you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and moderate that content in connection with the Service. You warrant that your content is lawful, is your own or that you have permission to post it, and is not defamatory.

We may remove content or accounts that we reasonably consider harmful, false, or in breach of these Terms.

10. Acceptable use

You agree not to: scrape, reverse-engineer, or overload the App or Website; circumvent deal limits, paywalls, or access gates; provide false information; harvest other users' data; use the Service for any unlawful purpose; or interfere with other users' enjoyment of the Service.

11. Intellectual property

The App, Website, branding, and our original content are owned by us or our licensors. Venue names, logos, and photos may belong to those venues or their licensors. You may use the Service for personal, non-commercial purposes only. You must not copy, resell, or frame the Service without our written permission.

12. Privacy and cookies

Your use of the Service (including the App and the Website) is also governed by our Privacy Policy. That policy explains how we collect, use, store, and share personal information, including through Apple, Google, and other service providers we use to operate the Service.

The Website uses cookies and similar technologies, including for online advertising. A cookie notice is shown on the Website. Details, including how to manage cookies, are in the Privacy Policy.

We do not sell your personal information. Contact us if you wish to access or correct your information or close your account.

13. Third-party services

The Service relies on third-party providers for sign-in (including Apple and Google), app distribution, maps, payments, hosting, email, push notifications, analytics, and advertising measurement. Those services are not under our control. Your use of them is subject to their terms. We are not responsible for third-party outages or their handling of your data beyond our instructions to them. 14. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, or free of harmful code, or that listings will result in a discount, a table, or a particular saving.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law that cannot be excluded.

15. Limitation of liability

To the maximum extent permitted by law, we are not liable for:

  • any venue's failure to provide a listed deal or discount;
  • incorrect or outdated information in the App or on our Website;
  • loss of enjoyment, wasted travel, meals you paid for, or incidental expenses;
  • loss of profits, data, or goodwill, or any indirect or consequential loss;
  • prize draw outcomes other than delivery of a prize we have confirmed to a valid winner, subject to the Website prize terms.

Where our liability cannot be excluded, it is limited (at our option) to resupplying the Service or paying the cost of resupply, or, for paid membership, a refund of the amount you paid us for the Service in the 12 months before the claim — except where the Australian Consumer Law requires otherwise.

Our total aggregate liability to you for all claims arising out of the Service is otherwise limited to the greater of AUD $50 and the amount you paid us in the 12 months preceding the claim.

16. Indemnity

You agree to indemnify us against claims, losses, and reasonable costs arising from your misuse of the Service, your breach of these Terms, or content you submit, except to the extent caused by our negligence or unlawful conduct.

17. Suspension and termination

You may delete your account in the App. We may suspend or terminate access if you breach these Terms, if required by law, or if we discontinue the Service. Provisions that by their nature should survive (including disclaimers, liability limits, and intellectual property) continue after termination.

18. Restaurant and venue partners

If you use the Website or related tools as a restaurant, cafe, or venue partner (including listing claims, partner signup, or paid listing plans), you warrant that you are authorised to represent that venue, that offer details you supply are accurate, and that you will honour advertised kids-eat-free or discounted offers subject to the conditions you publish.

Partner listing fees, if any, are billed as described at checkout through our payment provider. Partner tools may be changed or withdrawn. These Terms apply in addition to any separate partner agreement we issue.

19. General

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.

If a provision is unenforceable, the rest remains in effect. These Terms are the entire agreement between you and us about the Service. We may assign the Service to a successor. You may not assign your account without our consent. A failure to enforce a right is not a waiver.
